Non-EU Nationals require a residence permit to be employed in Malta. The first step in qualifying for employment is to have an employment offer from an employer in Malta.

 

A residence permit on the basis of employment is issued and remains valid if the main criteria upon which it was acceded to, continue to be met, that is, the specific designation, employer and duration. This information is also printed on the residence card issued and held by the third-country national.

 

If any of these criteria change or stop being effective, the holder of the permit is obliged by law to inform the Expatriates Unit within Identità and return the residence card immediately. Failure to do so would be in violation of the Immigration Act (Cap. 217) of the Laws of Malta and may be subject to further action by the Principal Immigration Officer.

 

Employment must be located in Malta and the holding of a residence permit does not give the holder the right of movement within the EU in terms of employment.

 

The most common types of employment-related residence permits are:

 

  • Single Permit;
  • Self-Employment;
  • Employment of less than six (6) months;
  • Blue Card;
  • Intra-Corporate Transferee.

 

Single Permit Applicants seeking to work in the Tourism and Hospitality Industry

 

As of the 28th May applicants for a Single Permit to work in the tourism and hospitality sector must submit a Skills Pass issued by the Maltese Institute of Tourism Studies, as part of the supporting documentation with their application.

 

Applicants who submit their application whilst Still Abroad (outside the Schengen area) must complete Phase 1 of the Skills Pass before starting their application process with Identita and submit this with the rest of the required documentation. Once Identita processes the application and issues the Approval in Principle letter, the applicant must complete Phase 2 and achieve the full Skills Pass before applying for an entry visa (where applicable) and proceeding to Malta to finalise the single permit application.

 

New Single Permit applicants must submit the Skills Pass at the application stage, whereas applicants who are changing jobs from a non-hospitality industry to a hospitality industry position, as well as those applying for a change in their designation within the hospitality and tourism industry, must present their Skills Pass during the application process.

The below are the most common documentation required for the submission of a Single Permit Application (including Renewals and Change of Employer).

Passport and a copy of the same full passport:

  • Original passport must always be presented at Identità offices;
  • A copy of the whole passport in (.pdf) format, including blank pages must be presented;
  • Passport must be valid for at least eight (8) more months from the date of application;
  • Visa on passport (Schengen or other) is valid for at least the application period.

Health Insurance Policy:

  • A health insurance policy with a minimum coverage of €100,000, providing medical treatment, including outpatients and hospitalisation coverage in Malta and, if necessary, in other European countries. The insurance policy must have a validity covering the entire period of stay in Malta.

  • A copy of the original has to be submitted and presented;
  • Document must be signed by both employer and the non-EU national applying for the Single permit;
  • Position of employment must be the same in all the submitted documentation.

  • Advertisement is not older than six (6) months from the date of application.

Qualifications of the applicant (Non-EU National):

  • All qualification certificates are to be accompanied with the recognition from the Malta Qualifications Recognition and Information Centre (MQRIC). Should the recognition by MQRIC still be pending, their receipt is to be attached instead.

Accommodation agreement (Lease or Rent):

  • An original contract is to be presented with the original signatures of both landlord and tenant;
  • Details of landlord and tenant on the contract should include name, ID card number, and the rent address;
  • The contract is to be accompanied by the Declaration by Landlord form;
  • If Landlord is not Maltese, a purchase agreement of the same premises needs to be presented;
  • Contract must not have details crossed off in pen or white-out and written over.
  • Applicants who will be residing in a hotel or guest house, need to upload the Keeper’s Declaration Form.

Lease Agreement Attestation Form (Link):

  • To be presented filled and signed by the landlord and also officially stamped by a lawyer, notary, or legal prosecutor;
  • A copy of this form must be kept by the lessor.

Declaration of Accommodation (Link):

  • To be presented filled and signed by an official company representative or an individual offering accommodation at no charge;
  • A copy of this form must be kept by the lessor.

Housing Authority Approval Letter:

  • A copy of the approval letter issued by the Housing Authority for the registration of property as a rental as per Cap. 604 of Maltese legislation.
